Les associations dont l\u2019activit\u00e9 rel\u00e8ve d\u2019un secteur dans lequel il est d\u2019usage constant de ne pas recourir au contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, en raison de la nature de l\u2019activit\u00e9 exerc\u00e9e et du caract\u00e8re par nature temporaire de l\u2019emploi, peuvent conclure des contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e (CDD) dits \u00ab\u00a0d\u2019usage\u00a0\u00bb. Sont notamment concern\u00e9s l\u2019enseignement, le spectacle, l\u2019action culturelle, le sport professionnel ou encore les centres de loisirs et de vacances. <\/p>\n

Plusieurs CDD d\u2019usage peuvent \u00eatre successivement conclus avec le m\u00eame salari\u00e9 \u00e0 condition que l\u2019emploi qu\u2019il occupe soit par nature temporaire. <\/p>\n

Ainsi, dans une affaire r\u00e9cente, la Cour de cassation a requalifi\u00e9 en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e les CDD d\u2019usage successifs conclus pendant 6\u00a0ans par un professeur assurant l\u2019enseignement de l\u2019architecture. En effet, ces contrats portaient, non pas sur un emploi par nature temporaire, mais sur un emploi indispensable \u00e0 l\u2019activit\u00e9 normale et permanente de l\u2019association employeuse, une \u00e9cole d\u2019architecture.<\/p>\n
